Invoice factoring in Florida: a local contact, a Miami office and the cost disclosure Florida law requires.
I'm based in West Palm Beach, and 1st Commercial Credit has a sales office on Brickell Avenue in Miami. If your Florida company invoices other businesses or the government and waits 30 to 90 days, factoring turns those invoices into cash. And since 2024, Florida law requires a written cost disclosure on factoring deals of $500,000 or less, before you sign.

Florida law: the disclosure you're owed before you sign
Since January 1, 2024, the Florida Commercial Financing Disclosure Law requires providers to give you a written disclosure, at or before signing, on commercial financing deals of $500,000 or less. Factoring is included: the law covers "accounts receivable purchase transactions".
Banks and their affiliates, deals over $500,000 and providers with five or fewer Florida deals a year are exempt.
- The total amount of funds provided.
- The amount actually disbursed, if fees or prior balances are taken out first.
- The total you'll pay the provider.
- The total dollar cost.
- How and when you pay, or how variable payments are calculated.
- Any cost or discount for paying early.
Brokers in Florida can't charge you an advance fee (except third-party application costs such as credit checks or appraisals), can't make false or misleading statements, and must show their address and phone number in their ads.
